1. Purpose
Ferpa Çimento Anonim Şirketi ("FERÇİM" or "Company") aims to process the personal data of employee candidates in accordance with the Personal Data Protection Law No. 6698 ("Law") and other legislation provisions.

Your personal data that you have notified/will notify to our Company due to the fact that you are an employee candidate of our Company and/or your personal data obtained by our Company in any way externally are processed by our Company in the capacity of "Data Supervisor",

  • Within the framework of the purpose that requires the processing of your personal data and in connection with this purpose, in a limited and measured manner,

  • Maintaining the accuracy and the most up-to-date version of the personal data you have notified or as notified to our Company,

  • We inform you that it will be recorded, stored, preserved, reorganized, shared with institutions authorized by law to request this personal data and transferred to domestic or foreign third parties under the conditions stipulated by the PDP Law, transferred, classified and processed in other ways listed in the PDP Law and may be subject to other transactions listed in the PDP Law.

 
2. Collection and Procedure of Personal Data of Prospective Employees
FERÇİM will process the personal data of employee candidates for the purposes specified in this Policy. In case of any change in the purpose of processing personal data, the employee's permission will be obtained separately.
The personal data of the employees collected and used by FERÇİM are specifically as follows:

All kinds of personal data processed for obtaining information that will be the basis for the formation of the personal rights of real persons who are in a working relationship with our Company (Identity information entered in the personal file, job application form, passport size photograph, education information, graduation information, diploma sample, profession, place of previous employment, resume information, military service status, private pension information).
 
3. Explanations on the Processing Process of Personal Data of Prospective Employees
FERÇİM may continue to store personal data belonging to prospective employees even if the purpose of use has disappeared, if stipulated in another law or if a separate consent is given by the relevant prospective employee. Except for this exceptional case, in case the purpose of data processing disappears, the personal data in question will be deleted, destroyed or anonymized immediately by FERÇİM.
 
4. Purposes of Processing and Transfer of Employee Candidate Personal Data to Third PartiesYour personal data may be processed and transferred for the reasons listed below and within the scope of the personal data processing and transfer conditions specified in Articles 5 and 6 of the Personal Data Protection Law No. 6698.
 
For the purpose of establishing an employment contract;

  • Job applications are processed in order to carry out recruitment and placement processes.

Your personal data will be kept for a reasonable period of time specified in the relevant legislation or until the purpose of processing disappears and in any case until the statutory statute of limitations expires.

5. Rights of the Prospective EmployeePursuant to Article 11 of the Law, the prospective employee whose personal data is processed may apply to FERÇİM and make requests regarding the following issues:

  • Learn whether their personal data is being processed,

  • Request information if their personal data has been processed,

  • To learn the purpose of processing personal data and whether they are used in accordance with their purpose,

  • To learn the third parties to whom personal data are transferred domestically or abroad,

  • To request correction of personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

  • To request the deletion, destruction or anonymization of personal data in the event that the reasons requiring the processing of personal data disappear and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

  • To object to the occurrence of a result to the detriment of the data subject by analyzing the processed data exclusively through automated systems,

  • To demand compensation for damages in case of damage due to unlawful processing of personal data.


Employee Candidates will make their requests arising from the Law through the "Personal Data Owner Application Form". FERÇİM will finalize the application requests free of charge in accordance with Article 13 of the Law, according to the nature of the request and within 30 (thirty) days at the latest. In case the request is rejected, the reason(s) for rejection shall be notified in writing or electronically with reasons.

The Candidate Employee undertakes that his/her personal data subject to this Policy is complete, accurate and up-to-date. In case of any change regarding his/her personal data, he/she may request his/her personal data to be updated by informing FERÇİM. FERÇİM shall have no responsibility in the event that the Employee Candidate does not provide accurate and up-to-date information.

This Clarification Text may be revised by FERÇİM when deemed necessary. In cases where revision is in question, employees will be informed about this issue. You can access the most up-to-date version of the Policy from the link www.fercim.com.tr.
