Purpose

Ferpa Çimento Anonim Şirketi ("FERÇİM" or "Company") aims to process the personal data of its real person customers in accordance with the provisions of the Personal Data Protection Law No. 6698 ("PDP Law") and other legislation.

Your personal data that you have notified/will notify to our Company due to the fact that you are a real person customer of our Company and/or obtained by our Company in any way externally by our Company in the capacity of "Data Controller" by our Company,

  • Within the framework of the purpose that requires the processing of your personal data and in connection with this purpose, in a limited and measured manner,

  • Maintaining the accuracy and the most up-to-date version of the personal data you have notified or as notified to our Company,

  • We inform you that it will be recorded, stored, preserved, reorganized, shared with institutions authorized by law to request this personal data and transferred to domestic or foreign third parties under the conditions stipulated by the PDP Law, transferred, classified and processed in other ways listed in the PDP Law and may be subject to other transactions listed in the PDP Law.

 

With the Clarification Text, it has been adopted to maintain and develop the activities carried out by FERÇİM in accordance with the principles set forth in the PDP Law.

1. Collection and Procedure of Personal Data of Natural Person Customers

Our Company will process your personal data for the purposes specified in this Clarification Text. In case of any change in the purpose of processing your personal data, your consent will be obtained separately.

Personal data belonging to employees collected and used by our Company, in particular, are as follows:

Identity Data

Documents such as driver's license, copy of identity card containing information such as name-surname, Turkish ID number, tax ID number, license plate, gender, and signature/signature information.

Contact Data

Telephone number, fax, address information, postal code, e-mail address (including extension number and corporate e-mail address).

Financial Data

Information such as bank information, check number, invoice data, account number, mortgage information, sales information, information on the receipt.

Customer Transaction Data

Information such as order number, date and subject of sending e-mail regarding the transactions made by customers with our Company.

Other Data

Information such as the subject of the complaint, vehicle type, investigation summary, reception points, dispatch address, declaration number, visiting hours, SAS number, weighbridge information.

Your personal data is collected through all kinds of information, documents and documents that you have submitted to our Company both before the establishment of the contractual relationship and after the establishment and continuation of the contractual relationship and obtained from third parties, public institutions and organizations for reasons stipulated by law.

2. Purposes and Legal Grounds for Processing Personal Data

Your Personal Data may be processed by our Company for, but not limited to, the following purposes.

Your Personal Data is processed in order to fulfill legal obligations and contractual requirements, including but not limited to the Customs Law.


In order to fulfill legal obligations in accordance with the Customs Law and the relevant legislation, laws, regulations and communiqués in force, in particular;

  • Issuance of the customs declaration.

 

For the purposes of contract formation and performance, in particular;

  • Establishment and performance of the sales contract,

  • Execution of order processes,

  • Sales reporting,

  • Recording and follow-up of dealer visits,

  • Check registrations and follow-up,

  • Invoicing,

  • Managing risk processes,

  • Scale operations are carried out.

 

For the purpose of establishing, exercising and protecting a right, in particular;

  • Managing customer satisfaction processes.

  • Collecting and managing customer complaints.

 

Your personal data will be kept for a reasonable period of time specified in the relevant legislation or until the purpose of processing disappears and in any case until the statutory statute of limitations expires.

3. Ensuring the Security and Confidentiality of Personal Data

In accordance with Article 12 of the PDP Law, our Company takes all necessary technical and administrative measures to prevent unlawful processing of personal data and unlawful access to personal data, and to ensure the appropriate level of security to ensure the protection of personal data.

A. Technical Measures Taken to Ensure Lawful Processing of Personal Data and to Prevent Unlawful Access to Personal Data

FERÇİM has taken all kinds of technical and technological security measures to protect your personal data and has taken your personal data under protection against possible risks.

B. Administrative Measures Taken to Ensure Lawful Processing of Personal Data and to Prevent Unlawful Access to Personal Data

  • Training and raising awareness of company employees regarding the PDP Law,

  • In cases where personal data transfer is in question, ensuring that a record is added to the contracts concluded with the persons to whom personal data is transferred that the party to whom personal data is transferred will fulfill data security,

  • Determining the requirements to be fulfilled for compliance with the PDP Law and preparing internal policies for their implementation,

C. Measures to be Taken in Case of Unlawful Disclosure of Personal Data

 

In the event that the processed personal data is obtained by others illegally, our Company will notify the relevant data subject and the Board as soon as possible.

4. Deletion, Destruction and Anonymization of Personal Data

Pursuant to Article 7 of the KVK Law, personal data shall be deleted, destroyed or anonymized by our Company ex officio or upon the request of the personal data owner, if the reasons requiring the processing of personal data disappear, although the personal data has been processed in accordance with the relevant legislation.


The procedures and principles regarding this matter will be fulfilled in accordance with the PDP Law and the secondary legislation to be established on the basis of this Law.

5. Rights of the Customer

Pursuant to Article 11 of the PDP Law, you may make requests regarding the following issues regarding your personal data by applying to our Company:

  • Learn whether their personal data is being processed,

  • Request information if their personal data has been processed,

  • To learn the purpose of processing personal data and whether they are used in accordance with their purpose,

  • To learn the third parties to whom personal data are transferred domestically or abroad,

  • To request correction of personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

  • To request the deletion, destruction or anonymization of personal data in the event that the reasons requiring the processing of personal data disappear and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

  • To object to the occurrence of a result to the detriment of the data subject by analyzing the processed personal data exclusively through automated systems,

  • To demand compensation for damages in case of damage due to unlawful processing of personal data.

 

Our Company will fulfill your requests arising from the PDP Law through the "Personal Data Owner Application Form".  In accordance with Article 13 of the PDP Law, our Company will finalize your application requests free of charge within 30 (thirty) days at the latest, depending on the nature of the request. If the request is rejected, the reason(s) for the rejection will be notified to you in writing or electronically with the reasons.


This Clarification Text may be revised by our Company when deemed necessary. In cases where revision is in question, you will be informed about this matter. The most current version of the Clarification Text is available on the internet at www.fercim.com.tr.
